Terms and Conditions
Welcome to Peexsell. These Terms and Conditions ("Terms") govern your access to and use of the corporate website (peexsell.com), corporate consulting pathways, and any business services provided by Peexsell, its internal child branches, and departments (collectively, "Peexsell," "the Company," "we," or "us").
By accessing our website, purchasing our software architectures, or entering a commercial engagement with us, you contractually acknowledge and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease using our corporate platforms and services.
1. Software Ecosystem & Platform Boundaries
Peexsell is an independent software development company that builds, owns, and manages its own unique ecosystem of proprietary technology platforms.
- Platform Exclusions: These corporate Terms apply exclusively to your interactions with the central Peexsell corporate environment and our agency division (SIGMA).
- Independent Frameworks: Our standalone commercial applications — specifically (Shop) and (MoneyApp) — operate as standalone platforms. Once deployed, those consumer platforms are governed by their own independent, platform-specific Terms of Service and End User License Agreements (EULAs).
2. No Professional or Financial Advice
Peexsell is a technology company, not a financial advisor or fiduciary.
- The Advisory Disclaimer: The information, tracking formats, budget structures, and content presented on or through our platforms (including personal finance tools within our incubated ecosystems like MoneyApp) are made available solely for general organizational purposes.
- No Substitute for Professionals: Our software does not provide financial, investment, tax, legal, or accounting advice, and is not a substitute for professional bookkeeping or audited accounting systems. You should consult qualified professionals for advice specific to your business or individual situation.
3. The SIGMA Development Wing (B2B Agency Provision)
Peexsell operates a specialized, client-facing development department under the brand name SIGMA, which engineers custom software, tailored mobile/web applications, and system integrations for third-party businesses and organizations.
- Bespoke Deliverables & Intellectual Property: Unless explicitly varied by a written Master Services Agreement (MSA), all foundational code libraries, generic frameworks, pre-existing software tools, and design templates used by SIGMA remain the exclusive intellectual property of Peexsell. Upon final, verified payment of all contract fees, the client is granted a perpetual, non-exclusive, royalty-free license to execute and run the bespoke software solution developed specifically for them.
- Handover & Operational Liability: Once a custom software pipeline is built and handed over to a third-party client, that client assumes full operational control and statutory liability as the Data Controller under national laws. Peexsell holds no liability for downstream system failures, data leaks, or regulatory non-compliance on systems operated by external clients.
4. Commercial Transactions and Payment Policies
When purchasing digital assets, software licenses, or funding engineering milestones through our platforms, you agree to comply with our transaction policies in line with national consumer protection frameworks:
- Electronic Contracting Validity: In strict accordance with national law, electronic transactions, digital confirmations, and automated agreements executed on our platforms carry full legal recognition and cannot be denied enforceability on the sole ground that they were formed electronically.
- Obligation to Pay: Placing an order, approving a project phase, or interacting with a checkout mechanism explicitly implies a contractual obligation to pay the supplier.
- Secure Payment Processing: To maintain technical security, Peexsell does not collect or store full card numbers or bank account details on our servers. All raw billing inputs are routed through encrypted gateways managed exclusively by licensed, third-party payment service providers.
- 60-Day Billing Dispute Window: If you believe you have been incorrectly charged for any software subscription or development milestone, you must notify us in writing at
help@peexsell.comwithin 60 days of the charge. Failure to notify us within this period constitutes your formal acceptance of the charge.
5. Cooling-Off Rights and Digital Contents
For any standalone digital software content or standardized corporate licenses purchased directly through our electronic commerce channels:
- The Cooling-Off Window: In compliance with national consumer protection laws, a consumer is entitled to cancel an electronic distance contract for digital software content within seven (7) days from the date the contract is concluded, entirely without penalty or reason.
- Monthly Subscriptions: Standard monthly software subscription fees are non-refundable, and we do not provide retroactive refunds or discounts based on feature usage variations or service interruptions.
6. Prohibited Uses and System Security
In strict accordance with the Computer Crime and Cybercrime Act, 2022, you are legally prohibited from executing, or attempting to execute, any of the following hostile behaviors against our corporate environments or infrastructure:
- Illegal Access & Interception: Logging into or attempting to gain unauthorized access to any restricted part of our computer systems, server databases, or corporate communication feeds.
- System Interference: Inputting malicious code, deploying scripts designed to damage or deteriorate computer data, or initiating denial-of-service (DoS) or botnet attacks to overwhelm network resources.
- Reverse Engineering & Forgery: Modifying, reverse-engineering, hacking, or altering our underlying software source codes, headers, or unique identifiers.
- Scraping & Monitoring: Use robots, spiders, scrapers, or other automated devices to access, extract, or monitor any material hosted on our Services.
- Abuse Towards Personnel: Engage in harassing, threatening, discriminatory, or abusive verbal or written behavior toward Peexsell's employees, support team members, or developers.
Any individual or entity violating these provisions commits a serious criminal offense under national law, and Peexsell will cooperate fully with law enforcement agents, providing server data logs to facilitate active criminal prosecution.
7. Proprietary Rights and Copyright Protection
All graphics, source code architectures, interface layouts, text content, brand assets, logos, and corporate designs housed on peexsell.com or distributed via our ecosystem are the exclusive property of Peexsell or its licensors. You may not copy, frame, modify, or redistribute our company assets without express, prior written authorization from our corporate board. Any unauthorized exploitation of our intellectual property will face immediate civil remedies and asset forfeiture measures.
8. Account Security and Confidentiality
If you create an account profile on our platforms, you are entirely responsible for maintaining the confidentiality of your username, password, or associated single sign-on security metrics.
- Shared Access at User Risk: Should you choose to share your security tokens or account access with another individual or team entity, we disclaim all liability for any data loss, structural modification, or data exposure that results from that action.
- Reporting Compromises: You must notify our technical team immediately at
privacy@peexsell.comif you become aware of any unauthorized use of your credentials or any secondary breach of platform security.
9. Internal Complaints and Legal Jurisdiction
- The 5-Day Dispute Protocol: To comply with national electronic supplier regulations, Peexsell maintains an active internal complaint-handling system. We commit to addressing, processing, and responding to formal electronic consumer grievances within five (5) days of their submission, entirely free of charge to the user. Formal complaints must be directed to
help@peexsell.com. - Escalation Pathway: If a transaction conflict cannot be resolved through our internal mechanism, consumers retain the right to leverage the alternative dispute resolution (ADR) processes offered by the Eswatini Communications Commission (ESCCOM).
- Governing Forum: All matters relating to these Terms, your access to our Services, or any contractual claims shall be governed by and construed in accordance with the laws of the Kingdom of Eswatini, and disputes shall be determined by the competent courts or regulatory tribunals sitting in Eswatini.
10. Legal Liability Cap & Disclaimer of Warranties
To the maximum extent permitted under applicable law, the collective liability of Peexsell, its child branches, affiliates, employees, or directors to any participating party (regardless of the form of action, whether in contract, tort, or otherwise) will not exceed the total amount you have paid directly to Peexsell for the specific service or product during the twelve (12) months preceding the date out of which the liability arose.
Our corporate digital assets are provided on an "as-is" basis. While we maintain technical safeguards to protect our networks, we do not warrant that our online systems will run entirely without interruption or operational system delays. You are responsible for implementing sufficient checkpoints on your local hardware units to satisfy your unique requirements for data input accuracy, anti-virus protection, and for maintaining an independent backup external to our platforms for the reconstruction of any lost data.
11. Termination and Severability
We retain the absolute right to suspend or terminate your access to all or part of our Services for any serious violation of these Terms. If any specific provision of these Terms is held by a competent court or tribunal to be invalid, illegal, or unenforceable, that specific clause will be eliminated or limited to the minimum extent necessary, and the remaining provisions of these Terms will continue in full force and effect.
